Why? Is that how quick you were going when the camera took your photo. I think in all states, 40km/h means you'll be walking. In Vic. walking for 6 months $396 and I think 6 demerits. 25km/h over means walking for a month, $292 and 4 demerits.

95km/h in 70km/h zone= $150 and 2 demerit points.

110km/h in 70km/h area = $350 and 5 demerit points.

You better hope you weren't doing 111km/h....$1000 and 7 demerit points.

You should lose your licence in my opinion.

Not quite on the spot.
You have 28 days to accept the fine, pay it and from that day the suspension starts, or you can contest it, and wait maybe 5-6 months before it gets to court, and still be driving in the meantime.

Another thing. Here in Vic IIRC, 40km/h over gets your car impounded for 48hrs under our lovely new hoon laws.

Single lane?

If he was overtaking on a single lane, harsh deal... you want to spend the least amount of time on the 'wrong side' of the road. Dual lane, cop it sweet.

You don't need to go 40 over the speed limit to pass a car "allegedly" going 10 -20 under the limit......
That would have him travelling about 60kph faster than the car he over took...

Well come up here to sunny QLD where you have short overtaking lanes and 4WD idiots who do 80 in a double line 100 zone until it goes to a 2 lane stretch where they speed up to 110 before slowing back down to 80.
These overtaking lanes are often 10-20km apart.
Or the 4WD moron who decides to overtake a semi up a long steep hill taking the who hill to get past what there are 20 cars jammed behind him.
These is not a rare things. Any member who lives in regional QLD will tell you similar stories. I see it almost every day I travel on the Bruce Hwy between here and Brisvegas.

There are no absolute rules and no absolute situations. Everything must be assessed on its merits.

QPOL have been known to let off speeders with a warning while "councilling" aforementioned wombats on the odd occaision.

N.B. Although 4WDs make up the majority of the idiots, caravans (with blue/white number plates mostly), camrys, greeniemobiles and shoeboxes all have a reasionable showing.

30km/h above the limit and over is a bus ticket in NSW for at least 3 months, more if the points you get take you over 12. Count on at least $580 less to spend on those buses too!

Unfortunately here in Vic, there are absolute rules with regard to the above scenarios. Believe me......... been there, done that, argued that.
Cops down here appear to not be allowed to assess each case on its' merits :

Badnews. In WA you are looking at a lap dance from Allanah McTiernan and you arent allowed to close your eyes. You dont want to know wat happens for a second offence, but just think Carmen Lawrence in a thong...

Call me a hoon, but I prefer to spend the least amount of time on the opposite side of the road than I have to. If that means being 40 over the limit to do so, I suspect it's much safer than being 10 over the limit if those I was passing was doing 10 under the limit.

i 2nd that one, that how i was taught by my old man, spend as little time on the only side as possible, and if i get a guy infront of me doing say 10kms under i will pass him and will do it as quick as possible to get infront , then slow back down to the speed limit and would all be done in a few hundred metres too

Chances are if it's a 70 zone, then 110 is not safe.

Added to that, if there's a fixed camera there, it's probably also metro. We're not talking about getting stuck behind a caravan on a 2 way, single lane country road for 25kms. Seeing as we're all so concerned with safety here, maybe the safest thing is learning some patience.

If we are talking highways, then yeh I'd agree. But it still depends on conditions.

thing is, how much time off your trip are you shaving by overtaking and breaking the speed limit "to spend as little time as possible on the wrong side of the road"?

reminds me of a couple of nights ago on my way to work doing 80Km/h on Wembley Rd (80Km/h limit). i have a good 3 second gap between me and the car in front. enter WRX that thinks my speed is too slow for the road we're on : and overtakes me to get into the gap in front of me (single lane road) only for said subaru to come to a stop 200m ahead as he had to turn right at a set of lights in logan central.

as i go past him at the set of lights, i think to myself... what a hero. that was really worth it.

looks like this is what a lot of people here seem to think is the acceptable thing to do.

if money is no issue to you, then go for it. loose a few points off your license. me, i'd rather not give money away for the sake of shaving 1 minute off a half hour trip.

Depends...

A road that I use to travel to visit my parents is single lane and 80 zone for a good 20kms. I'd be a lot more alert on the road if I was at or a smidge above 80 than I would be if I was stuck behind a vehicle that is pottering along at 70 for the whole distance.
