Thanks to all the guys that came over to get my car moved today, sorry I wasn't there, but I have the flu and today is the first day I've spent more than a couple of hours out of bed. It was very much appreciated.

I now know why no one came back to my place after they'd seen the car (asides from Rob who had a nervous look on his face then took off rather quickly).

oh geez that doesn't look too good. Hope he didn't go to work on the panels ? So did you get the car and your other belongings home ?

Good luck on Tuesday, try to stay calm in court though. Hopefully justice will provail and this ***** get's what he deserves.

Funniest part of the day (and yes, there was one even when we saw the damage) was everyone standing around trying to work out how to get the spare engine out to the front. Different ideas for sliding it on something were discussed over a 10 minute period till I got bored and mentioned the unthinkable..."how about 6 of us just pick the ****ing thing up and carry it?" After a few odd looks....we did just that with no problem at all.

Glad to see what wasnt already damaged or stolen has been returned to its rightfull owners.

Yeah I know Rob, I'm just REALLY ****ed now.

Unfortunately it's not just the back window, there's body work as well, did anyone notice that he tried to lever the boot open?
Cracked tail light, new glove box and he can pay for a respray, with all the damn scratches that the broken glass caused as well as getting the damn thing detailed.

The cops just come over (I called a different station) but had to leave in a hurry, they're coming back tomorrow to make out a report. The first cop that saw it said "This is very uncool!"

Oh well at least they actually came out.. _

Just when I though I was > < far away from having my car back on the road again. :(

But try to think, how can you prove the landlord did this damage? Look at anything he might say..."someone jumped the fence and did it". I think you've got your work cut out for you, to pin in on him!

He locked me out of the premises I was renting before the lease was up, he therefore prevented me from being able to retrieve or look after the car. He had been ordered to open the house and gates and then after the order was sent to him that the damage was done.

Whatever was on the property he then assumed responsibility for when he changed the locks and chained up the gates.

I've already been told that I'll be compensated by VCAT and it will come out of the landlords pocket, he can try and place the blame on someone else until he's blue in the face. He is not looked on favourably by Residential Tenancies after refusing to comply with THREE orders!!

Did I mention the number of times I've been threatened and harassed?

He walked out crying last time, this time he'll be walking out with his b@lls on a platter!

Took 2 of us all of 2 minutes to get the gates off locks intact, removed a crossbeam and this opened the way for the gate to be lifted off the open style hinges. Then went in the house via a not very well secured window.

I take it the tow truck "choice" with his "Bro" and "Cuz" turned up in the time they said? A prime example of being in the right place at the right time for all parties concerned. Those fellas looked like they could have got the engine on there by themselves!

We were half hoping the landlord would show up while the AFF Lynch Mob (TM) Melbourne Chapter was present. The look on his face would have been priceless.

Well I just logged on and saw the damage and I'm a little shattered for you two. You have done so much right :Reverend: but have been so wronged by that :. a real roller coaster ride for both of you. You at least have most or all of your belongings back and now on to the court case. Dot your Is cross your Ts and everything else you have, at least you don't have to go back to the house any more any more, though if you drove past now and again take a few pictures of the house now being restored back to livable as added proof that he was just being vengefull, it was a shame you couldn't get a neighbour to alert you to the fact he was there, any chance you could go ask them if they saw anything? Keep up the good work I'm damn sure I couldn't have done what you are doing. out:

on the issue of going to court,
When you get the order for him to pay you $xxxxx.
Send a registered letter with a request for recipt as a letter of demand for the payment. give a period of 14 days for payment to be made into your account. (Do NOT give the option of cheque, it will conviently be lost in mail.)
Provide your account details so as the retsraining order does not have to be broken. Upon him not paying you which I suspect he will refuse. File another for enforcement of the order. that is, he has to give you his complete finacial status in writing, if he refuses that the court can order payment be taken from his account made payable to the court, in turn they pass it on to you.
You can also do one more thing that can **** him off majorly for 5 years, however it will cost you $40.00. You can become a paid member of a credit agency. They will list a default on his credit rating for 5 years. The moment it is paid make sure you inform the credit agency of payment. but the intial payment default will remain on his credit history for 5 years.
Look into it on the legal aid self helf site.

Once again, thank you VERY much to all who came along and helped, and even to the people who offered to help but were unable to do so for reasons beyond their control, it was appreciated and I feel I now owe a debt to you all - if there is ever any way I can help you guys out in the future, just let me know, ok?

Agreed Casper, it was rather funny the way we spent more time discussing various methods of moving the engine then how long it took for us to move it once we all tried to lift it at once.

Paul, yes they did arrive, but no, the car didn't end up coming home on the back of their truck. Long story short, their winch was stuffed, they managed to get the EB almost all the way onto the back of the truck before the winch gave up the ghost, sending the EB lurching off the back until the brakes were applied a split second later - by that time the rear wheels were already back on the concrete on the driveway. Real professional mob those guys, lol!

We had to look up tow trucks in the yellow pages, then wait for another one to arrive. It was interesting to move the engine then, we ended up using a couple of planks of wood and the tow trucks winch, and sliding the engine along over the planks of wood so we wouldn't damage the sump too much. So we finally got the EB and the engine back to our new place about 4pm.

Here are some pics that I took on my phone (so they're not the best pics, but that's ok because somebody else took high res pics on a real digital camera a little later) when I first saw the EB and what had happened to it. Note where all the glass is...





At least nobody can get to it now to damage it any more, and I'm sure if we hadn't got it back here yesterday, it would have suffered much more damage - as it is, there is enough damage to it to make us pretty damn upset - when we had a closer look at it after it had been dropped off by the tow truck, we noticed more and more things that we hadn't already noticed.

Oh yeah, I can't believe how much stuff was missing - the whipper snipper, the pnumatic (spelling?!?) jack, heaps of other things. He's going to wish that damage hadn't been done and those things hadn't gone missing, because no matter if he did it or not (and lets face it, it was most likely him, seeing as before and after the plates went missing the locks on the gates had been moved from one position on the gates to another, and without dismantling the gates it would be rather difficult to get the jack and other large heavy items out), he is responsable for them going missing, because as a result of his actions, we were unable to retrive our goods for ourselves without help and incurring extra costs. So, in short, by locking us out, he assumed responsability for the goods which were still there.

He's going to want some lube on tuesday when the judge finds out about all this!

PS. thanks for the advice Yaw, sounds like a good idea to me.

I cant wait to hear about what happens on Tuesday. This is like a soap opera where the good guys have been wronged and are now on the edge of kicking some legal ***.

Make sure a blow by blow account is posted and some photo's of him crying on the court steps would be nice too. Maybe make up a big OWNED poster for the court so when the jugde nails him you can get it behind him and get a few photo's of him with it in the background? :

In NSW you get the option of paying some money (approx $40) and the sheriff delivers the judgement summons which lists the amount being claimed plus the sheriff's fee and the date it goes to court.
If he fails to appear in court, or you win, the sheriff returns to the defendant's premises and lists property that the sheriff values as enough to satisfy the judgement debt, and until that debt is satisfied the defendant is liable to big fines if he disposes of or fails to take care of the goods that the sheriff lists. Been there, done that.
Should be something similar in vic, so once you get the order, follow it through...

The information that I have from the Tenants Union of Victoria regarding enforcing monetry orders has a number of options.

1. Letter of demand.
2. Register with the Magistrates Court, thus the order is then enforced as any other order made by the Magistrates court would be.

After registering with the Magistrates court, you can then take out an oral summons, the landlord has to give details of his current financial position and the answers to the financial position are then passed on to you (or me in my case).

If he still refuses to pay then it's on to the following:

Warrant to seize property,
Attachment of Earnings Order,
Instalment order.
