Default Mud flaps

I bought a set of Front and Rear mup flaps the other day. The Front ones went straight on but the top screw hole on the Rears falls about 40mm lower than the screw location inside the wheel well. When I took them back to the dealer they got a service guy out to have a look and he insisted that they aren't supposed to line up and you just drive the top screw into where it sits. The mup flap itself seems to fit the car perfectly but it seems odd that this top screw hole doesn't line up with the existing screw on the car.

Has anyone else come accross this before?
